SRP Elections Fill 46 Seats

Voters in Salt River Project elections Tuesday elected new officers and filled 22 seats on the board and council of the Salt River Project Agricultural Improvement and Power District and new officers and 20 seats on the board and council of the Salt River Valley Water Users’ Association – SRP’s collective governing bodies.

Results from Tuesday’s election become official after a canvass by the SRP boards at their next meetings on Monday, April 7. The newly elected officials will take office May 5 and 6. The terms of SRP president, vice president, board and council seats are all four years.

In unofficial results posted this morning, SRP President David Rousseau of Phoenix and Vice President John R. “Randy” Hoopes of Chandler were re-elected to their second four-year terms. Both candidates were unopposed.

In other unofficial results in which Board incumbents faced challengers, John “Jack” M. White Jr. of Phoenix was re-elected over Ray Arvizu of Phoenix for Seats 6 in both the District and Association; incumbent William W. “Bill” Arnett of Mesa held off challenger Connie Wilhelm of Phoenix for District at-large Seat 12; and incumbent Wendy L. Marshall of Phoenix defeated John Hulburd of Phoenix for District at-large Seat 14.

In contested board seats in which there was no incumbent seeking re-election, Mark V. Pace of Gilbert won Seats 10 in both the District and Association; defeating Mark J. Andersen of Gilbert in the unofficial results. Pace will succeed the retiring Dwayne Dobson on the Board.

In non-contested board seats, incumbent Paul Rovey of Peoria won Seats 2 and Deborah S. Hendrickson of Tempe won Seats 8 in both the District and Association.

In non-contested board seats in which there was no incumbent seeking re-election, Leslie C. Williams of Phoenix won Seats 4 in both the District and Association.

In contested Council races, unofficial winners were Jacqueline “Jacque” L. Miller, Nicholas J. Vanderwey and Robert W. Warren for Seats 6; and Dave B. Lamoreaux, William P. Schrader Jr. and William “Billy” P. Schrader III for Seats 10.

Also elected to Council seats were Jerry Geiger, Kimberly Owens and Bill Sheely for Seats 2; Garvey M. Biggers, M. Brandon Brooks and Michael G. Rakow for District 4; Christopher J. Dobson, Mark L. Farmer and Mark C. Pedersen for Seats 8.

Elected to Council seats were Geiger, Owens and Sheely for Seats 2; Biggers, Brooks and Rakow for Seats 4; and Dobson, Farmer and Pedersen for Seats 8.

SRP is locally regulated by officials elected from within the Salt River Reservoir District boundaries. The Association and District boards establish policy, approve annual budgets, and set prices and fees. Councils for both Association and District amend and enact bylaws, and make appointments to vacant board, council and vice president seats. Traditionally, candidates seek identical positions in each organization.

To be eligible to vote, District and Association electors must be the owner of qualified land, or an individual who has been appointed by the trustee(s) to vote qualified land held in a qualifying trust as of Dec. 22, 2013. In addition, District electors must be a qualified, registered Arizona voter and reside within the state of Arizona. Association electors must also be at least 18 years of age.

All Association positions and all but the four District at-large board positions (Seats 11, 12, 13 and 14) are elected on an acreage-based voting system. The four District at-large board members are elected on a one-vote-per-landowner basis.

SRP is the largest provider of water and power to the greater Phoenix metropolitan area.

Arizona Business Community Supports HB2111

The undersigned organizations and businesses want to express their strong support for the passage of HB2111 with the floor amendment that will be offered by Senator Steve Yarbrough. This final amendment represents major concessions to address concerns that have been expressed by the city representatives.

This final amendment reflects the cities’ request for a separate online portal for the collection of sales taxes in the 18 non-program cities. In addition, the amendment reflects the cities’ demand to maintain the authority to audit single-location businesses in their city. Lastly, the amendment removes all of the changes to prime contracting tax except for the trade and service contractors.

While the Yarbrough amendment reflects major concessions to the cities that undermine some of the important reforms recommended by the Transaction Privilege (Sales) Tax Simplification Task Force, we believe this final proposal still reflects historic progress that deserves final passage.

The Senator Yarbrough floor amendment will provide for the following:

* Single Point of Administration – the Department of Revenue (DOR) will become the single point of administration and collection of TPT. However, at the request of the cities, there will be a separate online portal for the 18 non-program cities. Despite this concession, the cities remain opposed because they want to continue to require businesses making paper sales tax remissions to pay the state and city separately. Their proposal provides most small businesses no administrative relief from making multiple payments to multiple jurisdictions each month.

* Single and Uniform Audit – DOR will administer a standardized state audit program where all state and city auditors are trained and certified by DOR. Despite major concessions from the business community to allow cities to continue to audit local businesses, the cities continue to push for further changes that will undermine much needed reforms to standardize state and local audits.

* Trade/Service Contracting Reform – Service contractors working directly for an owner to maintain, repair, and replace existing property would pay tax on materials at retail and not be subject to the Prime Contracting Tax. During Task Force deliberations, the cities repeatedly conceded that this area of the prime contracting tax was problematic and should be changed. However, after almost a year of study and discussion, they have offered a change to the taxation of service contractors that provides no administrative relief and couples that change with a request that the state give the cities $80 million from use tax collections.

Arizona’s chaotic and dysfunctional sales tax system has been the subject of considerable controversy at the Capitol for over 30 years. The creation of the Task Force, as well as the appearance for the first time that the cities recognized the need for reform, gave Arizona businesses great hope that this system would finally be reformed. We strongly encourage state policymakers to pass a sales tax reform bill that is grounded in sound tax policy and focuses on reducing the extraordinary compliance costs on Arizona businesses.

Carl Mulac Named Chairman, Home Builders Association of Central Arizona

In the most challenging of times with the economy, a home building company can succeed if one has the vision, the money, the people and the land — much like home building veteran Carl Mulac did.

Carl Mulac: New Chairman of the Home Builders Association of Central ArizonaCarl Mulac, the executive vice president of Avatar Holdings and President of Avatar Properties, was named Chairman of the Home Builders Association of Central Arizona. Mulac, very familiar with the leadership role, had served as Chairman in 2008 and Treasurer of the Association this past year.

“Home builders are ramping up as market conditions continue to improve and we are all very optimistic that 2012 will bring renewed interest in buying new homes. People are tired of waiting on the side lines and it is abundantly apparent that the market is on an upswing. I’m excited to help lead the residential construction industry during this dynamic time,” said Mulac.

In 2008, Mulac started Joseph Carl Homes in the Phoenix metro area, which built both active adult and traditional neighborhoods. With his experience of working with three major national home builders, Mulac managed to create a start-up company in the hostile real estate market that attracted attention from Avatar, a company with nearly five decades of experience in home building, land development, and other real estate operations. Avatar is traded on NASDAQ (AVTR) and has properties in central Florida and the Phoenix metro area. Its principal operations are based at its 55+ active adult community Solivita, and through its Joseph Carl Homes operation, in Central Florida near Orlando; and at its 55+ active adult community CantaMia and through its Joseph Carl Homes operations in the Phoenix metro area, which include the Preserve at Palm Valley, Sereno at Palm Valley, Blossom Hills and Arboleda Ranch, both in Phoenix. The two companies combined business operations in 2010 with Mulac in control of the operation.
