The law firm of Jaburg Wilk has announced that Matthew T. Anderson joined the firm as a Partner. He concentrates his practice on the defense of retailers, restaurants, and hospitality entities, and health care matters.  He also handles high-exposure litigation involving catastrophic injury, product liability, wrongful death, and professional liability.

Anderson’s clients include national hotel corporations, national restaurants, health management companies, and various medical-provider entities including physicians, hospitals, urgent care clinics, and other facilities.  He also advises physician groups on health care matters involving Medicare, Stark, and anti-kickback legislation.

Jason B. Castle, a partner at Jaburg Wilk has been named Outstanding Pro Bono Attorney of the Month by the Volunteer Lawyers Program.

The Volunteer Lawyers Program is a joint project of Community Legal Services Inc. and the Maricopa County Bar Association. This program consists of lawyers who volunteer their time to provide legal assistance to low-income Maricopa County residents.

Castle started volunteering when he realized the crucial need for legal services in the low-income community.

“It is such an honor to be recognized for my service and I’m eternally grateful for the recognition”, said Castle. “But, it is VLP that deserves the credit.  They provide a way for low- income people to access legal services and improve tough situations.”

Blake DeLong joins Jaburg Wilk

Prior to joining the firm, Blake was in-house counsel for a major insurance company and was a partner in a large Phoenix defense litigation firm. He is admitted to practice in both state and federal courts in Arizona.

How Does Arizona Same Sex Marriage Impact HR?

On Friday October 17, same sex marriages became legal in Arizona. What are the changes that Arizona employers and their HR professionals need to be aware of?

1. The definition of spouse in employee manuals and handbooks. If a generic definition, such as “spouse” is used, there should not be a need to update. However, if a specific definition was used such as “wife” or “husband” the employee manual may need to be revised.

2. Family Medical Leave Act (FMLA) now covers same sex spouses. Accordingly, FMLA policy and notices may require modification. For private employers, FMLA still does not cover domestic partners, only married couples, and FMLA only applies to employers with 50 or more employees.

3. Insurance coverage needs to be offered to all qualifying employees and dependents.This includes all legally married couples.The marriage will be a qualifying life event and will trigger an open enrollment.  Insurance carriers may require proof of marriage.

4. Federal and state tax forms may be updated to reflect the same sex couple’s new filing status.

5. Beneficiary forms for pension plans and life insurance may need to be changed to note “spouse” designation rather than “other”. Pension plan records need to be updated to show status as married and any authorization that require spousal consent will need the new spouse’s signature.

6. Any benefit that the company extends to heterosexual married couples should be extended to same-sex married couples.

Carr boosts Jaburg & Wilk’s insurance litigation team

Jaburg Wilk Celebration Benefits 3 Valley Charities

In celebration of 30 years, Jaburg Wilk is holding a charity carnival and silent auction. All proceeds will go to local charities Ryan House, Devin’s Gift and St. Joseph the Worker.

The event takes place Wednesday, June 18 from 11 a.m. to 1:30 p.m. at the Great American Tower, 3200 N. Central Ave., Phoenix.

Aioli Burger food truck will be selling lunch and will be donating a portion of their profits to the charities. There will be a silent auction consisting of prizes donated by local businesses and St. Joseph the Worker’s revamped mobile unit will be onsite for touring. Popcorn, cotton candy and snow cones will be provided.

Ryan House provides respite and palliative care to children with life-threatening conditions and, as needed, end-of-life care. Devin’s Gift provides shower kits to Phoenix Children’s Hospital and Cardon’s Children’s Hospital. St. Joseph the Worker helps individuals return to the workforce and become self-sufficient, productive members of society.

All three charities will be on site to talk about their cause.

Adam M. Weiler and Aaron K. Haar have joined the Phoenix business law firm Jaburg Wilk as attorneys to expand the Insurance and Commercial Litigation practice groups.

Adam M. Weiler has worked in general insurance defense litigation for most of his career. He handles a variety of tort defense litigation with an extensive background including representation of insurance companies in first party matters as well as representation of insureds in third party tort lawsuits. He worked as in-house counsel at a major insurance company for several years handling tort and personal injury litigation, probate matters, wrongful death and subrogation matters. Prior to starting in private practice, he worked as a law clerk at the Maricopa County Attorney’s office in the homicide, vehicular crimes and preliminary hearings bureaus.

Before attending law school, Aaron K. Haar worked in the commercial real estate industry, spending two years in finance and two more in asset management. Gertsman Elected Actors Theatre Board President

Renee Gertsman, a partner with Jaburg Wilk, has been elected President of the Actors Theatre Board of Directors for the 2013-14 season, which begins Oct. 25 with A Steady Rain.

Gertsman will be joined on the executive committee by William Allison, vice president, an attorney with Gallagher & Kennedy; Cathiey Lanier Lemon, secretary, a community volunteer; Sara Gordon, senior vice president, J.P. Morgan Chase; and Oonagh Boppart, past president, a community volunteer.

“With our recent pause nearing an end, our new board leadership is prepared to guide a refreshed and refocused Actors Theatre back to audiences that are open to boldly experiencing the world from new perspectives through theatre that is powerful and talk-provoking,” said Managing Director Erica Black.

In February, Actors Theatre announced it was “taking a pause” to redesign its business model and consider future plans that included leaving the Herberger Theater Center as a resident company after more than 20 years.

“This is an exciting time for Actors Theatre and contemporary theatre in the Valley,” Gertsman said.  “The board and artistic management took a very brave step in pulling back to rethink and redesign and we’re all very anxious to experience the outcome of this new strategic direction.”

Denim Goes a Long Way at Phoenix Business Law Firm

Employees of Phoenix business law firm Jaburg Wilk asked management to have a Jeans for Charity day to raise money for the 19 firefighters who were killed while battling the Yarnell Hill Fire.

Employees were able to wear jeans to work if a donation was brought in for the 19 firefighters. Various attorneys then matched the total amount of money brought in by the firm.

The money was sent to the 100 Club of Arizona, a nonprofit organization dedicated to standing behind the men and women who stand behind the badge. The 100 club has been supporting Arizona public safety agencies, officers, firefighters, paramedics and their families through financial assistance, peer support training, safety enhancement stipends and scholarships for over 40 years.

“We are honored to contribute to the families of the brave men that lost their lives working to save the people and property of Arizona,” said Jaburg Wilk Managing Partner Gary Jaburg.

Identity Thieves Targeting the Deceased: Plan Now

Identity theft is always a difficult and frustrating situation and could take many years to repair the damage done to one’s credit. However, today millions of Americans are being haunted with an even more disturbing situation: learning that a criminal is using the identity of a deceased loved one to apply for credit.

An ID Analytics study determined 2.5 million deceased Americans identities are stolen each year. Targeting the deceased is appealing to identity thieves because it can take up to six months for death records to be registered, giving thieves ample time to rack up charges. Thieves scour through obituaries to obtain the victim’s name, age and birthdate. They are then able to locate the Social Security Number through the Social Security Administration’s list of deceased Americans known as the “Death Master File.”

This could turn out to be quite a headache for surviving family members as they are left to manage the estates of their deceased loved ones. Luckily, a simple yet effective estate plan can safeguard you or your family members if identity theft after death does indeed occur.

For example, storing all important account information within your estate plan and designating a financial power of attorney to monitor your information after death will help reduce the risk of identity theft. It is also crucial to notify the proper Government agencies of one’s death right away which helps limit opportunities for identity theft occurring.

Scottsdale League for the Arts Appoints Board Member

Susan E. Wells, partner of business law firm Jaburg Wilk, has been appointed to the Board of Directors of the Scottsdale League for the Arts.

The Scottsdale League for the Arts is a non-profit volunteer organization supporting artists, arts programs and education through fundraising and special events, including the Scottsdale Culinary Festival. Funds raised are granted to arts-focused organizations.

Wells has been a member of the organization for three years and has been actively involved for five. In April 2013, she chaired the VIP Passport to the Picnic Experience at the Scottsdale Culinary Festival. She founded and chaired the “Take the Cake Competition,” a cake decorating contest for professionals and culinary art students that showcased participant’s creativity and talents to top pastry chefs and Wine Country Brunch guests. In 2014, she will co-chair the “Friends of James Beard Benefit Dinner,” a culinary feast prepared by several James Beard award-winning chefs and held at the Westin Kierland Resort and Spa.
